I think I answered my own question, since, on Wikipedia, it does mention Satellite radio, and some shows at broadcasted, often simulcasted on the FM band!!

Maybe, with all this new fancy technology, the FCC had to give a little!!!! It SHOULD be, this year, when they finally accomplish, no blaring TV commercials laws!!! Takes them time, you know, 2-3 years!!
